Terms of Service

Welcome to Call Analyst. By using callanalyst.app or any related subdomain (collectively, the "Service"), you agree to these Terms of Service ("Terms"). If you don't agree, don't use the Service.

1. Service Description

Call Analyst is a software-as-a-service tool that connects to third-party meeting transcription services (Fireflies, Otter, Fathom) and uses AI providers (Anthropic Claude, OpenAI) to analyze transcripts you submit. We provide a thin layer of analysis on top of services you've already configured separately.

2. Account & Eligibility

• You must be 18 or older.
• You're responsible for keeping your account secure and for all activity under your account.
• One person per account. No sharing accounts to bypass per-seat pricing.
• You must provide accurate information when signing up.

3. Subscription & Payment

• Pricing: $50 USD per month, billed monthly in advance after a 7-day free trial.
• Payment is processed by Stripe. We never store your card details.
• The free trial requires a valid payment method. Your card is not charged during the trial.
• You can cancel any time through the in-app "Manage" portal. Cancellation stops future renewals; no partial-month refunds.
• Failed payments will result in subscription suspension after Stripe's standard retry period.
• We may change pricing with 30 days' notice. Continued use after notice constitutes acceptance.

4. Acceptable Use

You agree NOT to:

• Use the Service for illegal activity, including illegal recording of conversations.
• Submit content that violates intellectual property rights, contains malware, or is otherwise harmful.
• Reverse engineer, scrape, or attempt to extract source code or AI prompts from the Service.
• Resell or sublicense the Service without our written consent.
• Abuse the AI features in ways that exceed normal individual professional use (e.g., bulk processing, training your own models on our outputs, automated abuse).
• Bypass the paywall or trial limits via technical means.

We reserve the right to suspend or terminate accounts that violate these terms.

5. Recording Consent

You are solely responsible for obtaining proper consent from all parties on calls you record or transcribe via your notetaker. Many jurisdictions require all-party consent. We are not responsible for your compliance with applicable recording laws.

6. AI Output Disclaimers

• AI analysis is generated by third-party language models and may contain errors, hallucinations, or inappropriate content.
• You should not rely on AI output as legal, financial, medical, or professional advice.
• You are responsible for reviewing and verifying AI output before acting on it.
• We make no warranty as to the accuracy, completeness, or fitness for purpose of AI-generated analysis.

7. Intellectual Property

• You retain all rights to content you submit (transcripts, context).
• You grant us a limited license to process your content solely to provide the Service.
• The Service itself, including its design and code, is our property and may not be copied.

8. Third-Party Services

The Service depends on third-party APIs (Fireflies, Otter, Fathom, Anthropic, OpenAI, Stripe, Supabase). We are not responsible for outages, changes, or behavior of those services. If a third-party service breaks our integration, we'll work to restore it but cannot guarantee timing.

9. Privacy

See our Privacy Policy, which is incorporated into these Terms by reference.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your account for violation of these Terms, non-payment, or for any reason with 30 days' notice. Sections that by their nature should survive (IP, disclaimers, limitations) survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

13. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your violation of these Terms, your misuse of the Service, or your violation of third-party rights.

14. Changes to Terms

We may update these Terms. Material changes will be announced via email or in-app notice. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of New York, USA, without regard to conflict-of-laws principles. Disputes shall be resolved in the state or federal courts located in New York County, New York.
